Terms of Service

Last updated: 02.02.2026

Welcome to Mary & Eleanor. These Terms of Service govern your access to and use of our website, online store, products, and related services.

The store is operated by Mary & Eleanor HK Limited, trading as Mary & Eleanor.

By placing an order or using our services, you agree to these Terms, subject to applicable consumer protection laws.

1. Eligibility

By purchasing from Mary & Eleanor, you confirm that you are at least 18 years old or otherwise legally able to enter into a binding purchase contract in your jurisdiction.

You agree to provide accurate billing, delivery, and contact information.

2. Product Information

We make reasonable efforts to display accurate product descriptions, images, specifications, and pricing.

Minor variations in appearance may occur due to lighting, photography, manufacturing tolerances, and screen settings.

Such variations do not excuse the supply of products that are materially different from their description.

We reserve the right to update product descriptions, specifications, and availability without prior notice, provided existing orders and statutory rights are respected.

3. Pricing and Payment

All prices are displayed in United States Dollars (USD) unless expressly stated otherwise.

Applicable taxes and additional charges, if any, will be shown during checkout.

Payment must be successfully authorized before an order can be processed.

We reserve the right to correct pricing errors. Where permitted by law, we may cancel an order affected by a genuine pricing or technical error and promptly refund any payment already received.

4. Order Acceptance

An order confirmation email acknowledges that we have received your order. It does not necessarily mean that the order has been accepted for fulfillment.

We may decline or cancel an order where reasonably necessary, including suspected fraud, unauthorized payment activity, inventory unavailability, material pricing errors, or delivery restrictions.

Where an order is cancelled by us, any payment collected for the cancelled goods will be promptly refunded.

5. Fraud Prevention

For transaction security, we may review orders that present reasonable indications of fraud or unauthorized payment activity.

We may request proportionate additional information to verify an order, using secure methods and in accordance with our Privacy Policy.

We will never require customers to send complete payment card numbers or card security codes by email.

6. Shipping and Delivery

Shipping arrangements, delivery estimates, and applicable charges are described in our Shipping & Delivery Policy.

Customers are responsible for providing accurate shipping information.

Delivery delays, missing shipments, and shipping-related disputes will be handled under our Shipping & Delivery Policy and applicable law.

7. Returns and Refunds

All eligible returns are governed by our Return & Refund Policy.

Our standard discretionary return window is 30 calendar days from delivery, subject to the conditions published in that policy.

Nothing in these Terms restricts statutory refund, warranty, or consumer protection rights.

8. Product Use and Safety

Mary & Eleanor products must be used in accordance with their supplied instructions and safety warnings.

Customers should not modify or misuse electronic components, use damaged equipment, or disregard manufacturer safety guidance.

Mary & Eleanor is marketed as a comfort and wellness product and is not represented as a replacement for medical diagnosis or treatment.

Individual experiences may differ.

9. Intellectual Property

The Mary & Eleanor name, website design, original text, graphics, and other owned content are protected by applicable intellectual property laws.

You may not reproduce, distribute, or commercially exploit our original content without permission, except where permitted by law.

10. Customer Conduct

You agree not to use our website for unlawful, fraudulent, or abusive purposes.

We may restrict access or refuse future orders where there is a legitimate reason, including repeated fraudulent activity or serious misuse of our services, subject to applicable law.

11. Third-Party Services

Our website uses Shopify and may integrate third-party payment, analytics, shipping, and customer support services.

These providers may be subject to additional terms and privacy notices.

We remain responsible for obligations that applicable law places on us as the seller.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Mary & Eleanor and its operators will not be liable for indirect, incidental, special, or consequential losses that are not reasonably foreseeable or legally recoverable.

Where permitted by law, our aggregate contractual liability relating to a particular order will not exceed the amount paid for that order.

This limitation does not apply to liabilities that cannot legally be excluded or restricted, including applicable statutory consumer rights, fraud, willful misconduct, or personal injury liability where exclusion is prohibited.

13. No Medical Guarantee

Mary & Eleanor does not guarantee specific therapeutic, medical, or physiological outcomes.

Product information is provided for general wellness and informational purposes. It should not be interpreted as individualized medical advice.

14. Payment Disputes

If you experience a problem with an order, we encourage you to contact support@maryeleanor.shop so we can attempt to resolve it promptly.

This does not limit your right to contact your bank, payment provider, or relevant consumer protection authority.

We may submit relevant order records, tracking information, customer communications, and other lawful evidence when responding to payment disputes.

15. Governing Law

These Terms are governed by the laws of the Republic of Hong Kong, where the store operator is established, to the extent permitted by applicable law.

Nothing in this provision deprives consumers of mandatory protections or dispute-resolution rights granted by laws that apply to their purchases.

16. Changes to These Terms

We may update these Terms to reflect changes to our operations, products, or legal obligations.

Material changes will be communicated where required by law.

Changes will not retroactively remove rights that have already arisen under an existing purchase.

17. Severability

If any provision is held invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permissible.
